Compare with other countries

For decades, Spain was where holidaymakers learned to drive a boat. Rent a little 15 horsepower runabout for the afternoon, no licence, no questions, and potter along the Costa Brava or round a Balearic cove.

That era ended on 1 October 2026. Spain now wants renters to hold a qualification, and the rules for jet skis and beach zones are as strict as anywhere in the Mediterranean.

For owners of small private boats, including electric ones, the licence-free option still exists. We went through the new decree and the coastal rules so you know where it applies.

Paddle out without a licence: the private exception

You can drive a private motorboat without a licence if all of these apply:

  • the boat is up to 5 m long,
  • the engine is up to 15 CV, about 11 kW, without a power-reducing device,
  • you go out by day,
  • you stay within 2 nautical miles of the departure point,
  • you are at least 18.

Sailing boats up to 6 m used for sport and beach craft are covered by the same exception. Jet skis are not.

The documents still matter. Insurance, the seaworthiness certificate and the navigation permit must be on board.

The rental change: no more licence-free hire

Royal Decree 1188/2025 changed the rental rules from 1 October 2026. Anyone renting a recreational boat now needs the corresponding qualification. The reason given was the number of incidents involving licence-free rentals.

The entry-level qualification is the Licencia de Navegación: two hours of theory and four hours of practice, done in a day, for boats up to 6 m. Operators in the Balearic Islands expect more tourists to take the course, and then to ask for more powerful boats once they have it.

For electric rental fleets, the change removes the advantage of staying under 15 CV. If customers need a licence anyway, the size of the motor matters less than what the licence covers.

Our guide to renting out electric boats covers what this means for operators.

Jet skis: licence, circuit or nothing

Jet skis always need a licence for private use or day rental. Accepted qualifications include the Patrón de Navegación Básica, the PER and higher. Older jet ski licences issued before 1 July 2019 remain valid.

The exception is hourly rental inside a marked circuit. There, no licence is needed, an instructor supervises up to four jet skis, and each carries no more than two people. Circuits are set 300 to 500 m off the beach.

Local Coast Guard rules add more. In the Málaga area in 2026, for example:

  • jet skis may go no more than 1 nautical mile from the coast,
  • they may not ride within 400 m of the coast except on excursions or in circuits,
  • they keep 100 m from other boats.

Nothing in these rules separates petrol and electric jet skis.

Beaches: the swimmers are the locals

Each harbour master's office, the Capitanía Marítima, sets beach rules for its stretch of coast. Using Málaga's 2026 rules as an example:

  • Where bathing zones are not marked, the first 200 m off beaches and 50 m off the rest of the coast are reserved for swimmers.
  • Boats reach the shore only through marked channels up to 200 m long and 25 m wide, at no more than 3 knots.
  • The limit entering and leaving port is also 3 knots.
  • Licence-free rental boats were limited to 7 knots.

Check the rules of the Capitanía where you launch. They are published each year.

Inland waters

Spanish reservoirs are managed by river basin authorities, which decide what may sail on them, and some allow electric motors but not combustion engines. Our register of electric-only waters in Spain lists what we have found.

Alcohol and fines: avoid the wipeout

Spanish maritime law treats being in charge of a boat while drunk as a serious infraction, with fines of up to 120,000 euros. We could not confirm a specific blood alcohol limit for recreational boaters from an official source. Do not drink and drive.

Carrying no required documents is a minor infraction, with fines of up to 60,000 euros.

Charging after the session

Spain's public boat chargers are concentrated on the Catalan coast and in Mallorca, with new points planned around Valencia's Albufera. See the charging map for Spain and our guide on fast charging for boats.

Our verdict: own it, or get the licence

So, how does Spain treat electric boaters? Owners of small boats still get a licence-free window: up to 5 m and 15 CV, by day and within 2 miles, from 18.

Everyone else needs a qualification now, including anyone who wants to rent. The good news is that the entry-level licence takes a day. Get it, read the local Capitanía rules, and keep 200 m off the beach.
